Supreme Court Prohibits Occupation Of Public Spaces For Protests

The Supreme Court on October 7 said that though people have a right to protest, they cannot occupy public spaces indefinitely. The court added that the authorities should take action to clear protests from public places. The court was hearing a plea against blockade at Shaheen Bagh in Delhi during CAA-protests. Moreover, it allowed the government authorities to decide the manner in which protestors can be removed from such places.

The Time magazine has included 82-year-old Bilkis, who was one of the “dadis” to lead the anti-CAA protests at Shaheen Bagh in “100 Most Influential People of 2020”. The article, penned by journalist Rana Ayyub, states that Bilkis did not move from the protest site despite cold winters and fear from CAA supporters. She inspired thousands of others including students and leaders to join the protests, staying in roadside tents for months.

Supreme Court: Right to Protest Should Not Obstruct Right to Movement

The Supreme Court on September 21 stated that people's right to protest is not absolute. The bench stated that there should be a balance between the "Right to Protest" and the "Right to Movement" of people. The court further said, "There cannot be a universal policy because situations and facts are different every time."
